I currently work as an "independent contractor" but am basically treated and regarded as an employee with none of the perks or security. Beginning to wonder how kosher this is, and if I should bother taking any action.

I found this interesting article online: http://thingstodoaboutnothing.blogspot.com/2008/03/your-rights-as-indepedent-contractor.html

Anybody in a similar situation or have any insights to share?

No Conversations.... Is this Microphone on?

Hello Fellow Tribers:

I am on over 30 Tribes and only a couple of them have a post here or there. Is Tribe.net a dieing social network? There seems to be more activity on MySpace and YahooGroups.

If it weren't for the spammers, AdSense, and MLM offers there would be no activity in most tribes....

I would love to see some meaningful conversations here... Am I the only one?

I would love to hear some feedback.... Let’s get some topics rolling... is there anyone out there who has a question, or struggle or an idea that they want to get some feedback on?

I look forward to chatting with you all soon.

Sincerely,

Maximum Balance for Maximum Change

The concept of 'Maximum Balance' is a contradiction by nature. Maximum implies an extreme, the upper limit, the most. Balance implies moderation, evenness and trade-offs. Life, for many of us, is a struggle to achieve and maintain a growing and often contradictory set of goals. The pursuit of Maximum Balance is the challenge of constantly achieving superior results in all areas of life, without compromise. http://maximumchange.mbgroups.com/

* Have you ever been so focused on career success that your relationships with your friends and family suffered?
* How about never having the time to do something for yourself because everything you do is for your children and/or partner?
* Have you ever received a raise or promotion and you didn't stop to celebrate because you were already thinking about the next one?
* How about getting so focused on your personal challenges or needs that your job suffered?
* Do you ever find yourself so obsessed with financial success that you can't enjoy the benefits of that success?
* Or maybe you're so worried about financial disaster that you can't relax?
* Have you ever felt so overwhelmed by everything in life that you just didn't know where to focus your efforts?

It is the challenge of being able to achieve success in all areas of life, without compromise, that led us to develop Maximum Balance. Using the Internet and Maximum Balance Interactive as the foundation of the Maximum Balance Framework, we have developed a dynamic, interactive approach to personal achievement that is action-oriented and results-driven. Our free Getting Balanced program will get you started. And our innovative products will give you the personalized approach you deserve to achieve your goals online and offline — call it your Life MBA. http://maximumchange.mbgroups.com/

OUR MISSION

The Maximum Balance mission is to transform the way people achieve and maintain their life goals and objectives through our unique personal achievement program. By delivering the systems, tools and support that enable people to achieve success across five critical Cornerstones of life — personal, relationships, career, finance and giving-we believe we can help more people maximize the success they achieve in life for two reasons. First, we believe the Internet is the best foundation to deliver a program that can be constantly refreshed and personalized over time, versus traditional programs delivered via books and CDs where the content can't be updated in real-time. Second, we believe our unique approach to providing an integrated program across the five Cornerstones of life provides people with a system that realistically addresses the interactions of all of life's challenges and opportunities. We are driven each day to connect with those that are interested in improving their own lives as well as the lives of people around them by providing an easy-to-use program to help them achieve Maximum Balance. http://maximumchange.mbgroups.com/

On average I receive at least three new F&T membership requests a week. That must make ours one of the fastest growing tribes with the least activity.

Whether you recently joined us or have been with us for a while, please take the time to answer the following questions.

1. What brought you to this tribe?

2. If you've come here seeking advice, what's your number one burning question?

3. How do you presently earn a living?

4. How would you like to earn a living?

5. Is freelancing your only source of income? What else do you do to generate income?

6. What do you like best/least about freelancing?

7. If you already have a successful freelancing career, what advice would you give to people just starting out?

Blowing off steam again. Oh, how I hate not getting paid. I currently have two useless credit cards because I can't pay their bills -- not because I didn't have work, but because the accounts-payable people have just flaked, losing invoices or just mysteriously forgetting to send my check.

This makes me so angry, I could just -- grrrr.

Tax strategies

Another frequent question on this tribe ... "getting screwed on taxes."

Personally, when I get paid, I save 30% of every penny i earn for taxes. And that has been a broad rule-of-thumb that has served me well at tax time. I find that I've saved enough, and I can write a frighteningly huge check to Uncle Sam, and cover it just fine. And I never consider touching that money for ANYTHING but taxes.

Anyone else have any tax strategies that work?

I have a great shot at a huge assignment and was asked to just come up with some more research/storylines for my pitch, and I'm doing anything in my power to NOT get this in... this happened last year with a tryout to write for a TV show, they loved the first pass and I never did the 2nd... what is WRONG with me? I keep wasting HUGE opportunities and then returning to little dinky assignments that drive me nuts and frustrate me. Anyone else do this? I keep complaining about the glass ceiling in magazine freelancing, but I'm doing this to MYSELF -- I can't get to the next level if I keep doing this. UGH. I'm depressed.

For me, it's been networking person to person, getting referrals from current clients and calling on the new ones with the old, "I got your name from John Doe who thought you might like my work ... " Not being pesky, but staying on their radar in a likable way.
What has worked best for everyone else?

I would like to use something like netmeeting but my client is stuck behind a firewall with uncooperative IT support people. Has anyone tunneled through firewalls to get a similar app running? Any other ideas on sharing desktops and video?

Freelance Article-Method & Rights

Hi all

Looking for advice on a project. I am writing a freelance article for a corporation to attempt to get them publicity. In the contract, I'm charging an hourly rate and am not inclined to write the article beforehand until I find a publisher- however their expectation seems to be that there will be a finished product (the article, though really the product should be the article--- published).

Since it's more efficient use of their hourly rate to me to pay me to research the article and...once we have a publisher, write to those specifications- that's what I'm inclined to do. Not write it while being paid hourly and then have to go back and edit to what the publisher wants instead. Which is best?

Also, when it does publish- I would prefer to take any compensation the publisher offers and instead not charge them for the hours spent writing. Or, should the publisher compensate them and I take my hourly rate for the hours spent writing?

When it publishes, should the first rights be assigned by me or them based on the choices I've posed in the paragraph above.

The crux of it is, yes, happy to write them the article even if a publisher is never found- but I don't think that's most efficient use of their dollars up front.

Thoughts? Thank you!

Rejection Letters- Freelance, Non-Fiction

Hi all,

I think this is a dumb question and a bit rhetorical but thought I'd reality check here: When you pitch a freelance piece to magazine editor and they choose to ignore your pitch e-mail, follow up phone call, and follow up e-mail forwarding the original pitch, that's standard right?

In order to really have grounds to push for a rejection letter, you probably have to send the whole piece right? Reason is the rejection letter can be used to support efforts at tax time to show you were actively freelancing (aka, great to get the letter within 6 months).

Any thoughts on this? I definitely am a new writer but don't cop to sacred cows of "never call an editor." I'm not pushy but I will persist for my "no" letter for above reasons with lots of weeks in between to give them a chance. The instance above it has been 6-7 weeks and no writers guides were available (encouraged to call editor for them) and no response times were listed either on their Web site.

Thoughts? Similar experiences? Thanks!

hey dread, I feel your pain. I just wanted to give a shout out and say that one reason maybe we don't post is that there's such a wide variety of professions. so when Alok posted his question, I was like "Oh, man, I don't know what he's talking about," and didn't think to post anything else.

So maybe we should just all be braver about just posting stuff and have faith that this tribe is so big, someone out there is bound to be in a similar situation.

And all should know that it's OK just to use this board to vent frustration, like when you have a dry spell OR when you get more work than you can handle, but you can't say no because you've had such a long dry spell.

:)

*Get Clients Now!* by C.J. Hayden

I'm impressed with Hayden's 28-day marketing system. A month seems to be a manageable time-frame for me to set aside some of my shyness about self-promotion.

(After the 28 days of "filling the pipeline" and following up the incoming opportunities -- the cycle begins again. But, um... I'll cross that bridge then.)

Hayden also made it clear to me how marketing a service differs from marketing a physical product, which is helpful to me as I design my marketing plan for my Editing Services.

I'm looking for a "business buddy" to share ideas and keep our momentum while working through a marketing cycle together. If you're in San Francisco, and you want to develop more clients, check out my listing of 1/18. (See this Tribe's home page listings.

Hi all,

I have started a consulting firm that focuses on business intelligence/ competitive intelligence for companies.I am young, and having worked in marketing and business development throughout my career I know that I have the skills to provide good results to potential clientele.

Now, I have just finished a pro bono contract for a manufacturer in order to start my consulting firm - they liked my work a lot. I am looking to build a portfolio of 3 more pro bono contracts with non-profits to build my credibility before I actively start pursuing paying clients.

My question is, would you reccommend this type of strategy or should I immediately go after smaller paying clients instead?

thanks,

Alok

Help Out sourcing government

Could someone please develop a software to simulate how congress and the senate work so that instead of electing representitives once every couple of years and getting fustrated b/c they lie to us during campaigns anyways, every person could participate in descision making from their desktop. Sure not everyone has a computer, but I bet we could buy one for everybody if we didn't have to pay for representitives.
Its only human to have a degree of bias and self-interest, but that should be each person's own choice, not hope that someone else will be looking out for you, what a sham. Its almost understandable that in the past people needed a system like our government to "pull" the masses along, but we have enough information these days to know that there are no answers, no right, no wrong, and for sure no superiority. There is only heartfelt honest participation in trying to do some good for all with our efforts.
a good top-notch computer will run you around $1500, a political campgain cost tens of millions. I can see your point that some will have greater access, probably because they deserve it, but I pose to you that this varienace in access will not only be less but also insignificant in comparision to the number of people that will have access to a greater participation.

Hi fellow freelancers, I'm waiting to hear on a possible long-term contract that could take me through may and help stockpile my income. But it's iffy at best, and honestly if it doesn't come through, I'm not sure how much longer I can do this self-employed thing, which will be very hard for me if I need to go back to working for someone else. I've found this past year--especially the past 6 months--to be the worst of all since the start of the economic downslide. Anyone else find this to be true? What is it, do you think, pre-election jitters?

Hello, fellow freelancers.
I'm new to the tribe. I'm a freelance copywriter in Seattle.
I've been freelance for almost a year-and-a-half now, busy at most of the major ad agencies in town, and a few gigs that have taken me out of town (Calgary, Philadelphia).
I'm also hunting for that perfect full-time position, but it'll have to be pretty great to get me to stop freelancing. I like it more than I thought I would.
Anyway, it's good to be here.

Health insurance

How does everyone handle their health insurance? How do you handle the rising costs?

Since 1996, I've been an employee of a temp agency, which finds me contract work (doing technical writing) with end clients. I have to get my own health insurance, which in my case covers both medical and dental.

My premiums are 4.5 times higher in 2003 than they were in 1996 and there is no end in sight. One forecast I saw indicated that by 2006, health insurance costs will almost double from where there are today.

I've checked around and I believe I'm getting the best price I can. So far, I've just been paying the increases, but what was a relatively minor expense in 1996 has become a major budget item today and it will only get worse in the coming years.

Luckily, I've never gotten sick, so I've never had to use my insurance for anything. But the premiums continue to increase steadily every year anyway.

Has anyone else experienced these same dismal conditions? What are you doing about it, if anything?

A woman without her man is nothing.

A woman: without her, man is nothing.
________________

I've just received a book through this new outfit called "BzzAgent," and was wondering what others' thoughts were concerning them. The gist of it is that they're a kind of P2P marketing service.

The book is 'Eats, Shoots & Leaves,' which features Pandas on the cover, painting over the comma in the title. It's a funny, self-deprecating work, and a surprise #1 bestseller in the UK.
I can recommend it in good conscience, although, being a stickler myself, I can't help but worry that the author's British usages will mislead American readers. Thus, we place all periods and commas within closing quotation marks, "like this," whereas they pick and choose, depending on the sense.

Anyway, not wishing to offend those of delicate sensibilities, my larger question has to do with when and where it is OK to engage in this kind of marketing effort on-line. Obviously, I don't want to spam, or leave others feeling as though they've been used. On the other hand, if it's a worthwhile product or service, and the reader can legitimately be supposed to have an interest in it ...

What do you guys think? I'm not getting paid to do this, though I did get the book for free.

I am looking for some legal advice, or at least some pointers to a good book on the subject.

I had an experience recently where I wrote a short article for an organization's newsletter, and was paid for it. Then I found out that one of the staff members had taken that article, changed it a little (maybe 30%), and was going to send it to a magazine under his name. Yikes!

Fortunately, I talked to the ED and the staff member and we straightened things out, but it did make me think about ways to protect my writing, even when I am selling it. Do you other freelancers use contracts? What are my rights?

I'm a freelance editor. I charge by the hour and I'm finding I'm getting called many times before the job and after the job. Calls are usually in reference to advice or the insecurity of a nervous producer/director. I want to charge a 15% production fee to offset the time. Also, when I offer a competetive rates people still balk and when I work people call me a genius (sorry I'm just an editor not a brain surgeon..lol). Any suggestions?

I know no other writers doing this, so I have no one to ask. Of course, I charge different prices for different types of jobs. For instance, I charged $20/hr for a 1.5 year book ghostwriting project. Now I charge $40/hr for marketing copy (with a medical tech edge). Am I a bargain, or a steal? I am good, but I know employers often feel "you get what you pay for." So writers, tell me if you will, what do you charge?

I've "freelanced" as a music-teacher and sales consultant---however, I've found it difficult to discipline myself without the office "groupthink" going on----anyone have this problem? If so, could you overcome it, and how?
Thanks!

I just deleted a topic advertising some kind of get rich quick opportunity. I don't know about you, but I get enough of this in my email. I also changed the tribe to "moderated" to keep out people who may join the tribe just to sell something.

Please don't post business opportunities to this tribe. Please do feel free to discuss honest issues that pertain to the freelance lifestyle and to ask or give advice.
Needing Guidance

Fellow freelancers:

I have sought you out in the hopes that you can provide me with some much-needed guidance in the murky world of self-employment. I am self-employed in part by choice (I am also a dancer and this makes it hard for me to work conventional hours) and in part because I can't find a job in the Bay Area that isn't insulting to my values or pocketbook.

So here I am. I am a writer, and I like to think I'm a pretty good one. I have experience writing grants, promotional copy, magazine articles, educational materials, and academic drones. But now what? How do I drum up work for myself? I know that a good portion of freelancing is doing the legwork to find a client, but all of the sources I have been using (mostly personal connections) have dried up.

Any words of advice/encouragement would be much appreciated. I do like working in my pajamas, but it's a lonely world.

You don't need a boss, you just need a group.

Going at anything alone is against our human nature. We do things best in groups. We are the most successful superorganism the world has ever known, with capabilites of working together that took us to the moon! Am I to believe so many people are out of work because someone doesn't have something to tell them they could do? "We" can do anything and so we should shoot for taking all to the dreams past the moon and beyond the stars. Humans are not inherantly greedy (a stratagy that in a large population or heavy demand on limited resources is counterproductive), instead we achieve accomplishments by collaborating efforts torwards result. I do not think this neccessarally means we need supervision. If we have geninue desire to help and participate in what we find as worthwhile pursuits towards fulling and meaningful use of our talents, intrests, and resources as the best of all reward.
By participating in multiple activities and different efforts we can ensure variety and practicality of effecient enmass network response communication. All it takes is a common agreement to be humble and ernest in our interactions and utitlization of our talents and resources.
These social networks are a good start. Could you imagne how well services like these could work if they could be used for collaborative workgroup team project efforts? Suppose a group of music teachers wanted to incorporate efforts to share and schedule studio space/ equipment/ time/ talents/ crediability by accomplishment/ etc. to be able to offer a least minimum initial capital cost model, also utitlizing found network resources and recycling those resources across multiple directional efforts and activities to lower overhead.
Obviously alone these are near impossible odds to overcome as an individual or even as a group unless undiscovered talent lays waiting to found. Maybe one of them might know how to program a database but does not know to create a website. What if one of them knew how to build a website but neither of them knew anything about accounting? What if the music teacher intrested in or with past experience as a database programmer could enlist the services of the database programmers group to create a project workgroup to build the group a database. What if the member willing to be the accounting group resource lieason lead of the group to the accounting group could do the same, and the website creator, etc.
Depending on the rarity of the talent speciality or the proiliferation of the participation by a group-willing network to reach talents and oppertunites, it could not only be able but, also more likely possible to offer viaiable service solutions for the original music teachers. It is also the most likely method of being able to offer a more probable solution to the sceniero of offering all groups, internal and extenernal, accessibilty to the service by community groups effort. Talent and resources are never exshausted, they are spread and nurtured, it is organized for maximized effectiveness of use through sharing pooled achievments, and making ideas of innovation accessible from the most sources.
Maybe some project members could meet that would be willing to use one member's garage appartment as studio space, maybe some get married, or even just aggree to be try being able to share in living at one members house to use the other's members house as a large school space. What if clients also agreed to provide space and equipment for classes as part of service?
It statisticly makes sense. It might also sound too "Utopia". Does it sound like it can't be done? Do puzzle pieces have to have to also show the whole puzzle's picture or does a steering wheel need to know about pistons or need to be specificly designed for emissions? Of course not. All that needs to be done is something, anything one can. I'm betting it wouldn't hurt to try? It helps to realize you don't have to have an answer. If there was a single "true" answer, it wouldn't be a question. Its not about what is right or wrong, its about trying to get things done, its about what is and isn't, and its about providing all what can and needs to be.
We are all willing to do something all it takes doing what it is you do and being able to contact and add to groups also working at or willing to try to work at and/or share with as well. Eventual dissolution by task completetion, so as to offer service to public domain for re-use, restoring and recycling, a most important commitment. Afterall if your not going to accommplish what your working on and it couldn't help out some collective effort or maybe person or people, what are you doing? Why not help? Its how we got here, and its how we have any chance of progressing anywhere.
To me it is like the idea of "It takes a tribe to raise a child"...today children hardly have a family much less an intrested communitity that could help rear them. The oppertunities of talents they posses wasted by socital diefeciency at value recognition and thus unnuturing neglect and overall group hinderance through loss of those possibilities. What if a collaborative group-willing network effort share could recapture thoses chances and in the process could promote better ones. Where couldn't we go? What couldn't be done?

I work out of a tiny one-bedroom apartment as a writer-for-hire. Yeah, it's nice to show up at the office in my underwear, but then there's the claustrophobia and alienation.

I figure more and more people are freeIancing and/or telecommuting these days. There must be issues pertinent to this lifestyle such as lack of health insurance, job security, etc. Let's walk the tightrope of freelance employment together.
